Terms & Conditions

If you would like us to work for you, our terms and conditions will apply unless you have another written agreement with us. These terms and conditions (as may be updated from time to time) apply to all orders placed by our customers. If you have a question or require any more information please do not hesitate to contact us.

1. Introduction

1.1 These terms and conditions of business (“the terms”) govern all contracts made between Request a Guest for the supply of all graphic design, illustration, printing or goods and services (“the products / input material”) to any person, firm, charity or company (“the client”)

1.2 The terms prevail over any written terms and conditions of the client. Any variation to the terms must be agreed in writing by Request a Guest.

1.3 Any typographical, clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by Request a Guest shall be subject to correction without any liability.

1.4 Request a Guest reserves the right to change rates or the terms without prior notice.

2. Project Acceptance

2.1 At the time of proposal, Request a Guest will provide the client with a written estimate or quotation and (where necessary) a briefing document.

2.2 Not withstanding clause 2.1, if Request a Guest accept a verbal order from a client, Request a Guest shall not be held responsible for any mistakes (made by either party) arising from the verbal order.

2.3 A copy of the written estimate or quotation and (where necessary) briefing document will be signed and dated by the client to indicate the acceptance and should be returned to Request a Guest.

2.4 Upon reply to the estimate or quotation the client accepts the terms and conditions as cited in this document.

3. Charges, Payment and Delivery

3.1 Charges for the product or service provided by Request a Guest will be set out in the written estimate or quotation that is provided to the client. A deposit will be required to commence the development of the work and full payment will be requested before any final processing. Work on the project will not commence until Request a Guest have received cleared funds for the amount.

3.2 30 day credit accounts or any other period or type of credit is not offered by Request a Guest. Please refer to the terms outlined in clause 3.1.

3.3 Payments can be made by cash, cheque or previously agreed electronic transfer. 3.4 An additional fee of £50 will be incurred per returned cheque.

3.5 Unless otherwise stated in the quotation the price quoted is for collection of the product from Request a Guest.

4. Copyright, Intellectual Properties and Trademarks

4.1 By supplying Request a Guest with images, text, graphics or data, that is required for all copying, processing, scanning, printing and manipulation, the client warrants that it holds the appropriate copyright and no copyright or intellectual properties will be infringed by Request a Guest with the inclusion of these in any form in the requested artwork. The ownership of such material shall remain with the client, or rightful copyright or trademark owner.

4.2 Any artwork, images or text supplied and/or designed by Request a Guest on behalf of the client, will remain the property of Request a Guest. It is necessary to gain permission for the use of material in any other form than for which it was originally supplied. Permission (provided in writing) may be granted at the discretion of Request a Guest, and subject to additional fees.

4.3 Should Request a Guest or the client supply an image, text, graphics or any other file for use in any printed media, advertisement or any other medium believing it to be copyright and royalty free, the client shall agree if any subsequent infringement should arise, to allow Request a Guest to remove and/or replace the file. The client agrees to fully indemnify Request a Guest in any or all claims which may arise by virtue of any breach in the above warranties.

5. File and Data Format

5.1 The supplying of data or files to Request a Guest shall be of acceptable means, as defined in the following.

5.2 Text supplied to Request a Guest shall be in an electronic format, in either a standard text (.txt) or Word (.doc) file, saved to a CD-ROM, usb memory key, or sent via e-mail.

5.3 Images which are supplied in an electronic format, should meet the requirements prescribed by Request a Guest as outlined in either your written brief or as stated on the website : www.requestaguest.co.uk, and saved to a CD-ROM, usb memory key or sent via e-mail. Any images which may require manipulation before the inclusion into the document, Request a Guest shall not be held responsible if the client later deems these to be unacceptable. Request a Guest cannot be held responsible for the image quality of any images which the client has requested to be scanned from printed material.

5.4 Additional expenses maybe incurred for any necessary action including, but not limited to, photograph and art direction, photography searches, media conversion, digital image processing, or data entry services.

5.5 Any artwork supplied or formatted by the client should adhere to the guidelines as outlined by Request a Guest in the written or online document ‘Artwork Guidelines’. Incorrectly formatted artwork may incur additional expenses.

6. Alterations

6.1 Request a Guest will, (where necessary,) provide the client with a written design brief and/or an order form which will provide the framework for producing the products. This will form an agreement outlining the specific criteria of the products.

6.2 The client agrees that changes above and over the quoted or estimated work, or any deviation away from the written brief will be liable to an additional fee being charged.

7. Project Duration and Turnaround Times

7.1 Any indication given by Request a Guest as to the duration of a design project and/or printed work is only an estimation. It is the responsibility of the client to set out realistic timescales for the completion of a design project and/or printed work. Request a Guest cannot be held responsible for any project or printing over-runs, whatever the cause.

7.2 It is a client’s responsibility to meet any deadlines (written or verbal) set by Request a Guest, this includes, but is not limited to, the supply of text, images or other data required. Failure by the client to meet these deadlines can result in the design project and/or printed work missing the original estimated delivery deadline.

8. Rights of Refusal

8.1 Request a Guest will not include in its design project and/or printed work, any images, text or other data which is deemed to be immoral, offensive, illegal or obscene. Request a Guest reserve the right to refuse to include submitted material without given reason.

8.2 If any images or data are included in good faith from the client in the design project that contravenes these terms in 9.1, no responsibility shall be held by Request a Guest in any way. Request a Guest reserve the right to remove said images or data, without hindrance.

9. Cancellations

9.1 Cancellation of orders may be made initially by telephone, or e-mail, however, following this, Request a Guest will need formal notification via email or in writing to the company’s postal address.

9.2 The client shall indemnify Request a Guest in full against all loss (including loss of profits), costs (including labour and material used), damages, charges and expenses incurred by the client as a result of cancellation. This payment must be received within 7 days of cancellation.

 10. Warranties and Liability

10.1 Request a Guest warrants to the Client that the design project and/or printed work will be provided using reasonable care and skill and, as far as reasonably possible, in accordance with the written estimate, and quotation.

10.2 In respect of the supply of any product manufactured, Request a Guest warrants, subject to the following provisions, that at the time of delivery the products will correspond with their specification and will be free from defects in material and workmanship.

10.3 Request a Guest shall have no liability to the Customer for any loss, damage, costs, expenses or other claims for compensation arising from any Input Material or instructions supplied by the client which are incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form, or arising from their late arrival or non-arrival, or any other fault of the client.

10.4 The above warranties are given by Request a Guest subject to the following conditions:

10.4.1 Request a Guest shall not be deemed liable in respect of any defective design project work, graphics or printed material arisen from any images, text, or other data to meeting the correct format prescribed in section 6.0.

10.4.2 Request a Guest shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to following the instructions from Request a Guest (whether oral or in writing), misuse or alteration, or repair of any products without approval from Request a Guest.

10.4.3 Request a Guest shall be under no liability under the above warranties (or any other warranty condition or guarantee) if the total price for the design project work, graphics or printed material has not been paid by the due date for payment.
10.4.4 The above warranties do not extend to parts, materials or equipment not manufactured by Request a Guest, in respect of which the client shall only be entitled to the benefit of any such warranty or guarantee as given by the manufacturer to Request a Guest.

11. Proofs

11.1 Request a Guest will supply (where necessary) a printed proof for the purpose of clarifying colour, typeface, format, layout, addresses and numbers. No responsibility can be accepted where proofs are supplied and any errors, whether by Request a Guest or customer are not corrected by the customer at the time. If there are errors in the artwork supplied by the client, Request a Guest can accept no responsibility for such errors. Production will not commence without design approval and if this is not received the dispatch or delivery date of the order will be affected.

12. Claims

12.1 Damage, delay or partial loss of the product in transit or non-delivery must be given in writing to Request a Guest within 7 days of delivery. In the case of none delivery Request a Guest should be notified within 28 days of dispatch. All other claims must be made in writing to Request a Guest within 28 days of delivery. Request a Guest shall not be liable in respect of any claim unless the customer proves that it was not possible to comply with the company requirements.

13. Company Imprint

13.1 Unless otherwise stated all printed material shall carry our company imprint which will be positioned at our discretion.
